PENDEKATAN HHUKUM DAN EKONOMI TERHADAP HUKUM INTERNASIONAL: MENYIGI RASIONALITAS NEGARA

Hukum internasional kontemporer saat ini harus menggunakan pendekatan interdisipliner. Hal ini dikarenakan isu hukum internasional sudah semakin terspesialisasi. Pendekatan hukum dan ekonomi dapat digunakan untuk menganalisis hukum internasional. Asumsi pendekatan ini adalah bahwa subjek merupakan makhluk rasional sehingga akan berusaha untuk mewujudkan preferensinya. Negara sebagai subjek hukum internasional dilihat dari pendekatan hukum dan ekonomi merupakan aktor rasional sehingga setiap tindakannya ditujukan untuk memenuhi preferensinya.
