Analisis Penerapan Hukum Persaingan Usaha Dalam Menangani Praktik Monopoli di Indonesia

Competition law serves as a crucial pillar in maintaining a fair, efficient, and sustainable market. In Indonesia, this is regulated by Law No. 5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition.[1] This study aims to evaluate the effectiveness of the law’s implementation in addressing monopolistic practices by major enterprises. Using a normative juridical approach and case study analysis, the paper explores the national legal framework, institutional performance of the Indonesia Competition Commission (KPPU), and compares it with international practices, particularly those of the European Union. The findings indicate that while the legal foundation exists, structural limitations, regulatory inconsistencies, and low legal awareness among business actors hinder its enforcement. The study recommends legal reform, increased institutional capacity, and stronger inter-agency coordination to promote a competitive and just business environment.
