Dinamika Hukum Persaingan Usaha: Dari Prinsip Klasik hingga Era Ekonomi Digital

The rapid development of the digital economy has fundamentally transformed the landscape of business competition in Indonesia, which was originally regulated under classical principles embodied in Law No. 5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition. This study aims to examine the relevance and effectiveness of traditional competition law principles in addressing emerging challenges posed by digital business models, the use of algorithms, and digital platform ecosystems. In this context, the Indonesia Competition Commission (KPPU) faces significant challenges in defining digital markets, identifying anti-competitive behavior, and addressing cross-border business actors. The study also highlights the need for regulatory reform, including legal amendments and policy harmonization with international standards, as well as the enhancement of institutional capacity through information technology and global cooperation. This research seeks to provide responsive and adaptive policy recommendations to support fair business competition in the digital era.
